West Virginia State Code Section 29-6A governed statutory grievances for public higher education employees through June 30, 2007. On July 1, 2007, the governing State Code section shifted to West Virginia State Code Section 6C-2. The new grievance process for state employees including public higher education employees became effective on July 1, 2007. The governing sections of the West Virginia State Code are Section 6C-2 and Section 6C-3. The statutory grievance process operates along a timeline as discussed in the timeline chart described above. From time to time, it may be necessary or desirable through agreement of the parties to waive the timeline for some step in the grievance process. The President of Marshall University has designated the Director, Human Resource Services, to be the individual and office responsible for receiving grievances. Therefore, individuals wishing to file an initial grievance after July 1, 2007 are asked to complete the grievance form for Level One described above and submit it to the Director, Human Resource Services, Marshall University, 207 Old Main, One John Marshall Drive, Huntington, West Virginia 25755. Grievants at Level One indicate a choice on their grievance form as to whether they wish to be provided with a conference or a hearing.
