Learned<\/strong>\n<ul>\n<li>Must perform work requiring advanced knowledge in a field of science or learning; and<\/li>\n<li>The advance knowledge must be customarily acquired by a prolonged course of study\/specialized instruction.<\/li>\n<li>Predominantly intellectual\n<ul>\n<li><b>Sample Jobs <\/b>(Physician, Nurse Practitioner, Architect, Lawyer, Engineers, Athletic Trainers (certified), Clinical Social Worker, Chefs (4-yr degree program))<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li><strong>Executive Exemption Test<\/strong>\n<ul>\n<li>Primarily manages a division, department or subdivision; and<\/li>\n<li>Directs the work of two or more full-time employees<\/li>\n<li>Must have the authority or influence over the hiring, firing, promotion, demotion, discipline and recommendation to change employee status.\n<ul>\n<li><b>Sample Jobs <\/b>(Vice President, AVP, Director, Assoc\/Asst Director, some departmental managers)<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li><strong>Professional\u00a0Exemption Test . . . Creative<\/strong>\n<ul>\n<li>Primary duty must be the performance of work requiring invention, imagination, originality, or talent<\/li>\n<li>Performs work in a recognized field of artistic or creative endeavor\n<ul>\n<li><b>Sample Jobs <\/b>(Musicians, Composers, Actors, Painters, Writers)<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li><strong>Outside Sales\u00a0Exemption Test<\/strong>\n<ul>\n<li>The employee\u2019s primary duty must be making sales (as defined in the FLSA, see <a href=\"https:\/\/www.dol.gov\/whd\/overtime\/fs17f_outsidesales.pdf\">DOL fact sheet 17F<\/a>), or obtaining orders or contracts for services or for the use of facilities for which a consideration will be paid by the client or customer; and<\/li>\n<li>The employee must be customarily and regularly engaged away from the employer\u2019s place or places of business.\n<ul>\n<li><b>Sample <\/b><b>Jobs<\/b> (Door to Door sales, commission based sales offsite)<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li><strong>Computer Worker Exemption Test<\/strong>\n<ul>\n<li>Employed as a computer systems analyst, programmer, software engineer or similar skilled worker.<\/li>\n<li>Primary duties consist of:<\/li>\n<li>Applications of systems analysis techniques or<\/li>\n<li>Design, development, documentation, analysis, creation, testing, or modification of computer systems or programs.<\/li>\n<li>Design, documentation, testing, creation, or modification of computer programs related to machine operating systems.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>The types of duties\/exemption tests shown below are Based on primary job duties, not job title.
