Investigations and hearings avoid prejudgment of facts, conflicts of interest, and bias. This assessment may include:<\/p>\n<ul>\n<li>Assessing the Complainant\u2019s well\u2011being and offering supportive measures.<\/li>\n<li>Informing the Complainant about medical care, evidence preservation, and safety planning.<\/li>\n<li>Explaining the option to contact\u2014or decline to contact\u2014law enforcement, and how to seek protective orders.<\/li>\n<li>Explaining University and community resources and how to request supportive measures.<\/li>\n<li>Explaining dismissal, Informal Resolution (when appropriate), and Formal Resolution, and discussing the Complainant\u2019s preference.<\/li>\n<li>Explaining the prohibition against retaliation.<\/li>\n<li>Determining whether the report identifies parties and witnesses.<\/li>\n<li>Determining whether the parties are minors and whether child protective services must be contacted.<\/li>\n<li>Coordinating with MUPD and University officials to evaluate <strong>Clery Act obligations<\/strong>.<\/li>\n<\/ul>\n<\/div>\n\n\n                            <\/div>\n        <\/div>\n    <\/div>\n        \n    <div\n        id=\"step-2-option-for-resolution-is-determined-and-followed-2\"\n        x-data=\"accordion('step-2-option-for-resolution-is-determined-and-followed-2', false)\"\n        class=\"rounded-lg overflow-hidden mb-2 transition-all duration-300 ease-out bg-gray-50\"\n        x-bind:class=\"expanded ? Dismissal<\/h3>\n<p>A case may be <strong>mandatory dismissed<\/strong> or <strong>discretionarily dismissed<\/strong> under the rules in 34 C.F.R. \u00a7106.45(b)(3); parties have the right to <strong>appeal a dismissal<\/strong>.<\/p>\n<h3>2. Informal Resolution<\/h3>\n<p>For cases <strong>eligible<\/strong> for Informal Resolution, and only with both parties\u2019 <strong>voluntary, written consent<\/strong>, the matter may be resolved collaboratively with a trained facilitator <strong>at any time prior to a determination<\/strong>. Employee\u2011on\u2011student allegations <strong>cannot<\/strong> go through Informal Resolution.<\/p>\n<h3>3. Formal Resolution<\/h3>\n<p>If the matter proceeds formally, the University follows the required investigation, evidence review, live hearing with advisor\u2011conducted cross\u2011examination, written determination, and appeal procedures.<\/p>\n<\/div>\n\n\n                            <\/div>\n        <\/div>\n    <\/div>\n\n<h3>What are the different options for resolution?<\/h3>\n                                            \n        \n    <div\n        id=\"dismissal\"\n        x-data=\"accordion('dismissal', false)\"\n        class=\"rounded-lg overflow-hidden mb-2 transition-all duration-300 ease-out bg-gray-50\"\n        x-bind:class=\"expanded ? If they do not, the <strong>Formal Title IX Complaint<\/strong> (in whole or in part) must be dismissed <strong>for Title IX purposes<\/strong>; this does <strong>not<\/strong> prevent the University from addressing the conduct under other policies or processes.<\/div>\n<h3>Mandatory Dismissal (Title IX sexual harassment allegations)<\/h3>\n<div>\n<p>The University <strong>must<\/strong> dismiss the Formal Title IX Complaint (with respect to the Title IX sexual harassment allegations), if any of the following are true\u2014even if the allegations are assumed true:<\/p>\n<ul>\n<li>The alleged conduct <strong>would not constitute Title IX sexual harassment<\/strong> under the University\u2019s Title IX policy and the federal definition in 34 C.F.R. \u00a7106.30.<\/li>\n<li>The alleged conduct <strong>did not occur in the University\u2019s education program or activity<\/strong>.<\/li>\n<li>The alleged conduct <strong>did not occur against a person in the United States<\/strong>.<\/li>\n<\/ul>\n<p>A mandatory dismissal for <strong>Title IX purposes<\/strong> does <strong>not<\/strong> preclude the University from moving the matter to another applicable policy or code (e.g., Non\u2011Title IX or Student Code of Conduct procedures).<\/p>\n<\/div>\n<h3>Discretionary Dismissal<\/h3>\n<div>\n<p>The University <strong>may<\/strong> dismiss the Formal Title IX Complaint, or any specific allegations therein, at any time during the investigation or hearing if:<\/p>\n<ul>\n<li>The <strong>Complainant requests in writing<\/strong> to withdraw the formal complaint or any allegations.<\/li>\n<li>The <strong>Respondent is no longer enrolled or employed<\/strong> by the University.<\/li>\n<li><strong>Specific circumstances prevent<\/strong> the University from <strong>gathering sufficient evidence<\/strong> to reach a determination.<\/li>\n<\/ul>\n<h3>Notice of Dismissal &amp; Next Steps<\/h3>\n<ul>\n<li>The University will <strong>promptly send written notice<\/strong> of any mandatory or discretionary dismissal to both parties, including the <strong>reasons for the dismissal<\/strong> and information about the <strong>appeal process<\/strong>.<\/li>\n<li>Where appropriate, the Title IX Coordinator may <strong>refer the matter<\/strong> to another University office or procedure (e.g., Non\u2011Title IX procedures or Student\/Employee Conduct).<\/li>\n<\/ul>\n<h3>Appeal of Dismissal<\/h3>\n<ul>\n<li><strong>Either party may appeal<\/strong> a dismissal on the <strong>grounds permitted by policy<\/strong> (e.g., procedural irregularity that affected the outcome, new evidence that was not reasonably available, or bias\/conflict of interest).<\/li>\n<li>Appeals are decided by an <strong>Appeal Officer<\/strong> (or panel) who is <strong>not<\/strong> the investigator or the original decision\u2011maker. The Appeal Officer issues a <strong>written decision<\/strong> to both parties.<\/li>\n<\/ul>\n<h3>Supportive Measures &amp; Recordkeeping<\/h3>\n<ul>\n<li><strong>Supportive measures remain available<\/strong> to either party regardless of dismissal or forum.<\/li>\n<li>The University maintains <strong>dismissal notices and related records for seven years<\/strong> in accordance with Title IX recordkeeping requirements<\/li>\n<\/ul>\n<\/div>\n\n\n                            <\/div>\n        <\/div>\n    <\/div>\n        \n    <div\n        id=\"informal-resolution-2\"\n        x-data=\"accordion('informal-resolution-2', false)\"\n        class=\"rounded-lg overflow-hidden mb-2 transition-all duration-300 ease-out bg-gray-50\"\n        x-bind:class=\"expanded ? It is available <strong>only when <em>both<\/em> parties voluntarily agree<\/strong> to participate. Parties may request IR <strong>at any time prior to a determination<\/strong> in the case.<\/p>\n<div>\n<p><strong>Eligibility and limits.<\/strong> The University <strong>does not<\/strong> offer Informal Resolution to resolve allegations that <strong>an employee sexually harassed a student<\/strong>. IR will never be required as a condition of enrollment, employment, or participation in any program or activity.<\/p>\n<p><strong>Notice and consent (required by federal regulations).<\/strong> Before IR begins, the Title IX Office will provide <strong>written notice<\/strong> describing: (1) the allegations; (2) the <strong>requirements<\/strong> of the IR process, including any circumstances under which IR would preclude resuming the formal grievance process; (3) that <strong>either party may withdraw from IR at any time before agreeing to a resolution<\/strong> and resume the formal process; and (4) the <strong>records<\/strong> that will be maintained or could be shared. Each party must then provide <strong>voluntary, written consent<\/strong> to participate in IR.<\/p>\n<p><strong>Process and outcome.<\/strong> If both parties agree to use IR, the Title IX Office will work with the parties to explore resolution options. <strong>Any agreed\u2011upon terms will be reduced to writing and signed by the parties.<\/strong> If either party chooses to <strong>withdraw<\/strong> from IR before signing a final agreement, the case returns to the <strong>formal grievance process<\/strong>.<\/p>\n<p><strong>Advisors and support.<\/strong> Parties may consult with and be accompanied by an <strong>advisor of their choice<\/strong> throughout IR. The Title IX Office remains available for supportive measures and referrals regardless of outcome.<\/p>\n<p><strong>Recordkeeping.<\/strong> The University maintains <strong>Informal Resolution records (including signed agreements) for seven years<\/strong>, consistent with Title IX recordkeeping requirements.<\/p>\n<\/div>\n\n\n                            <\/div>\n        <\/div>\n    <\/div>\n        \n    <div\n        id=\"formal-resolution-3\"\n        x-data=\"accordion('formal-resolution-3', false)\"\n        class=\"rounded-lg overflow-hidden mb-2 transition-all duration-300 ease-out bg-gray-50\"\n        x-bind:class=\"expanded ? Parties may submit statements, documents, and witness names.<\/li>\n<li><strong>Evidence Review (10\u2011day window)<\/strong><br \/>\nBefore a report is finalized, each party and advisor receives\u00a0<strong>all directly related evidence<\/strong>\u00a0for inspection\/review and has\u00a0<strong>at least 10 days<\/strong> to submit a written response.<\/li>\n<li><strong>Investigation Report (10\u2011day window)<\/strong><br \/>\nThe Investigator issues a report fairly summarizing relevant evidence. Each party receives the <strong>investigation report at least 10 days<\/strong> before any hearing or determination, with the opportunity to respond.<\/li>\n<li><strong>Dismissal Review<\/strong><br \/>\nThe Title IX Coordinator reviews whether the matter requires <strong>mandatory dismissal<\/strong> (e.g., alleged conduct would not constitute Title IX sexual harassment even if proven or is outside jurisdiction) or <strong>permissive dismissal<\/strong> (e.g., complainant withdraws), or whether it should proceed to a hearing. Parties receive notice and may <strong>appeal a dismissal<\/strong>.<\/li>\n<li><strong>Pre\u2011Hearing Conference (for Title IX sexual harassment)<\/strong><br \/>\nA Hearing Officer\/Panel (independent from the investigator) addresses logistics, witness lists, and decorum. Under the 2020 Title IX regulations, the University must balance these requests with its legal obligation to respond <strong>promptly, effectively, and in a manner that is not deliberately indifferent<\/strong> once it has <strong>actual knowledge<\/strong> of conduct that may constitute sex discrimination or Title IX sexual harassment.<\/p>\n<div>\n<p>Below is how the University evaluates and responds to such requests.<\/p>\n<hr \/>\n<h3>Confidentiality and Anonymity<\/h3>\n<ul>\n<li><strong>Anonymity cannot be guaranteed when disciplinary or safety actions are taken.<\/strong> If the University must implement measures such as a No\u2011Contact Order, safety intervention, or disciplinary action, the Respondent must receive notice of the Complainant\u2019s identity.<\/li>\n<li><strong>Confidentiality is always respected to the extent possible<\/strong>, but it is not absolute. University officials may need to share limited information with personnel who have a legitimate need to know in order to respond appropriately.<\/li>\n<li><strong>Anonymous or third\u2011party reports still trigger University response obligations.<\/strong> Under the 2020 regulations, schools must respond promptly, even to anonymous reports, if they have actual knowledge of alleged Title IX sexual harassment.<\/li>\n<\/ul>\n<hr \/>\n<h3>Impact on the University\u2019s Ability to Respond<\/h3>\n<ul>\n<li><strong>The University may be limited in its response<\/strong> if the Complainant requests confidentiality or declines to participate. Without identifying information, the University may not be able to provide supportive measures or conduct certain aspects of an investigation.<\/li>\n<li><strong>If a Complainant requests \u201cno investigation,\u201d the Title IX Coordinator must balance<\/strong> the Complainant\u2019s preferences with the University\u2019s responsibility to maintain a safe and nondiscriminatory environment for all.<\/li>\n<li>The Title IX Office may still <strong>move forward without Complainant participation<\/strong> when required for campus safety or when independent evidence suggests that the Respondent may pose a risk to the community. This is permitted under 34 C.F.R. \u00a7106.44, which requires a prompt and effective response even when a Complainant is unwilling to participate.<\/li>\n<\/ul>\n<hr \/>\n<h3>When the University May Proceed Without Complainant Participation<\/h3>\n<p>The University may decide to pursue a matter without the Complainant\u2019s involvement when evidence exists beyond the Complainant\u2019s account, such as:<\/p>\n<ul>\n<li>Available <strong>security camera recordings<\/strong><\/li>\n<li><strong>Corroborating witness<\/strong> statements or reports<\/li>\n<li><strong>Physical evidence<\/strong><\/li>\n<li><strong>Admissions<\/strong> or statements suggesting responsibility by the Respondent<\/li>\n<\/ul>\n<p>These factors help Title IX Coordinators determine whether moving forward is necessary to protect the campus community.<\/p>\n<hr \/>\n<h3>Limitations on Anonymous Formal Complaints<\/h3>\n<ul>\n<li>A <strong>formal Title IX complaint cannot be anonymous<\/strong>, because federal regulations require the signed submission of a Complainant and mandate disclosure of identities in the <strong>Notice of Investigation and Allegations<\/strong>.<\/li>\n<li>However, individuals <strong>may report anonymously<\/strong>, and the University must still assess safety concerns, offer supportive measures when possible, and determine whether action is
