{"id":852,"date":"2024-03-27T15:44:13","date_gmt":"2024-03-27T15:44:13","guid":{"rendered":"https:\/\/www.marshall.edu\/titleix\/?page_id=852"},"modified":"2025-11-24T09:03:17","modified_gmt":"2025-11-24T14:03:17","slug":"important-definitions","status":"publish","type":"page","link":"https:\/\/www.marshall.edu\/titleix\/important-definitions\/","title":{"rendered":"Important Definitions"},"content":{"rendered":"<h2>Sexual Misconduct<\/h2>\n<ul>\n<li>Sexual Misconduct is a broad term that includes, but is not limited to, sexual harassment, non-consensual sexual contact, non-consensual sexual intercourse, sexual exploitation, dating violence, domestic violence, and stalking.<\/li>\n<\/ul>\n<h3>Non-Consensual Sexual Contact<\/h3>\n<ul>\n<li>Non-Consensual Sexual Contact is any intentional sexual touching, however slight, with any object, with another person without the consent of that person.<\/li>\n<\/ul>\n<h3>Non-Consensual Sexual Intercourse<\/h3>\n<ul>\n<li>Non-consensual sexual intercourse is any anal, oral, or vaginal penetration, however slight, with any object, with another person without consent of that person.<\/li>\n<\/ul>\n<h4><em>PROHIBITED CONDUCT INCLUDES, BUT NOT LIMITED TO:<\/em><\/h4>\n<ul>\n<li>Unwanted sexual intercourse with a stranger or a friend, acquaintance, spouse, current dating partner, or former intimate partner (including date or acquaintance rape)<\/li>\n<li>Unwanted sexual intercourse committed by force, threat, surprise, coercion, intimidation, or through use of mental or physical helplessness<\/li>\n<li>The use of force, including hitting, pushing, or otherwise acting upon violently to engage in sexual activity<\/li>\n<li>The use of force, including holding a person down, restraining, or otherwise preventing a person from leaving, to engage in sexual activity<\/li>\n<li>The use of threats, including a direct threat of death, grave bodily injury, or a negative consequence<\/li>\n<li>The use of one\u2019s size, power or authority to imply a threat, whether communicated verbally or nonverbally and\/or physically<\/li>\n<li>Sexual intercourse with an individual who is incapacitated due to alcohol and\/or drug use, and that incapacity is known or should have been known<\/li>\n<li>Sexual intercourse with an individual who is incapacitated due to mental disorder, developmental disability, intellectual disability, physical disability, age (being under 16), or family relations<\/li>\n<li>Sexual intercourse with an individual who was temporarily incapacitated or unconscious due to sleep or a medical condition such as an epileptic episode, panic attack, and PTSD.<\/li>\n<\/ul>\n<h2>Consent<\/h2>\n<ul>\n<li>Consent is a knowing, voluntary, and clear permission by word or action to engage in mutually agreed upon sexual activity.<\/li>\n<li>Silence or passivity is not consent. Consent is not passive, but is active and freely given. Silence, in and of itself, cannot be interpreted as consent.<\/li>\n<li>Consent can be given by words or actions, as long as those words or actions create mutually understandable clear permission regarding willingness to engage in (and the conditions of) sexual activity.<\/li>\n<li>Initiators of sexual activity are responsible for obtaining consent.<\/li>\n<li>Consent to one form of sexual activity cannot automatically imply consent to any other forms of sexual activity, nor does it automatically imply consent of any sexual contact in the future.<\/li>\n<li>Previous relationships or prior consent cannot automatically imply consent to future sexual acts.<\/li>\n<li>Consent granted to one individual does not automatically imply consent to any other parties.<\/li>\n<li>Consent can be withdrawn once given, as long as that withdrawal is clearly communicated. Once consent is withdrawn, sexual activity must stop reasonably immediately.<\/li>\n<li>Consent cannot be obtained from an individual who is incapacitated due to lack of consciousness, age, disability, or incapacitated due to drugs or alcohol.<\/li>\n<\/ul>\n<h3>Recognizing Non-Verbal Communication<\/h3>\n<p>There are many ways of communicating. The look on a person&#8217;s face or their body language are also a way of communicating. Often, nonverbal communication has more meaning than the words that come out of their mouth.<\/p>\n<p>Some examples of nonverbal communication that signal a person is uncomfortable with the situation are:<\/p>\n<ul class=\"default-list\">\n<li>Not responding to your touch<\/li>\n<li>Pushing you away<\/li>\n<li>Holding their arms tightly around their bodies<\/li>\n<li>Turning away from you or hiding their face<\/li>\n<li>Stiffening muscles<\/li>\n<\/ul>\n<p>Asking questions and being aware of body language helps you to determine if the person is consenting and feeling comfortable, or not consenting and feeling uncomfortable. If you get a negative or non-committal answer to any of the questions above, or if the person&#8217;s body language resembles any of the above examples, you should stop what you are doing and talk to them about it.<\/p>\n<p><strong>The best way to know that you have consent is to ask.\u00a0<\/strong><\/p>\n<h3>Why is Consent Important?<\/h3>\n<ul>\n<li>Communication, respect, and honesty make sex and relationships better.<\/li>\n<li>Asking for and obtaining consent shows that you have respect for both yourself and your partner.<\/li>\n<li>Positive views on sex and sexuality are empowering.<\/li>\n<li>It eliminates the entitlement that one partner feels over the other. Neither your body nor your sexuality belongs to someone else.<\/li>\n<li>It is normal and healthy for women to expect to be included in the consent process.<\/li>\n<\/ul>\n<h3>Asking for Consent<\/h3>\n<p>Show your partner that you respect\u00a0them enough to ask about\u00a0their sexual needs and desires. If you are not accustomed to communicating with your partner about sex and sexual activity, the first few times may feel awkward. But, practice makes perfect. Be creative and spontaneous. Don&#8217;t give up. The more times you have these conversations with your partner, the more comfortable you will become communicating about sex and sexual activity. Your partner may also find the situation awkward at first, but over time you will both be more secure in yourselves and your relationship.<\/p>\n<h3>When?<\/h3>\n<p>Before you act. It is the responsibility of the person initiating a sex act to obtain clear consent. Whenever you are unsure if consent has been given, ask. Check-in through out. Giving consent ahead of time does not waive a person&#8217;s right to change their mind or say no later.<\/p>\n<h3>How?<\/h3>\n<p>Consent is not just about getting a yes or no answer, but about understanding what a partner is feeling. Ask open-ended questions. Listen to and respect your partner&#8217;s response, whether you hear yes or no: &#8220;I&#8217;d really like to\u00a0. . . how does that sound?&#8221; &#8220;How does this feel?&#8221; &#8220;What would you like to do?&#8221;<\/p>\n<h3>Gauging Consent<\/h3>\n<h3>\u00a0 \u00a0 Red: Signs You Should Stop<\/h3>\n<ul>\n<li>You asked multiple times before they said yes.<\/li>\n<li>You are too intoxicated to gauge or give consent.<\/li>\n<li>Your partner is asleep or passed out.<\/li>\n<li>You hope your partner will say nothing and go with the flow.<\/li>\n<li>You intend to have sex by any means necessary.<\/li>\n<\/ul>\n<h3>\u00a0 \u00a0 Yellow: Signs You Should Pause and Talk<\/h3>\n<ul>\n<li>You are not sure what the other person wants.<\/li>\n<li>You feel like you are getting mixed signals.<\/li>\n<li>You have not talked about what you want to do.<\/li>\n<li>You assume that you will do the same thing as before.<\/li>\n<li>Your partner stops or is not responsive.<\/li>\n<\/ul>\n<h3>\u00a0 \u00a0 Green: Keep Communicating<\/h3>\n<ul>\n<li>Partners come to a mutual decision about how far to go.<\/li>\n<li>Partners clearly express their comfort with the situation.<\/li>\n<li>You feel comfortable and safe stopping at any time.<\/li>\n<li>Partners are excited!<\/li>\n<\/ul>\n<h3>\u00a0 \u00a0 Before you have sex, ask yourself&#8230;<\/h3>\n<ul>\n<li>Have I expressed what I want?<\/li>\n<li>Do I know what my partner wants?<\/li>\n<li>Am I certain that consent has been given?<\/li>\n<li>Is my potential partner sober enough to decide whether or not to have sex?<\/li>\n<li>Am I sober enough to know that I&#8217;ve correctly gauged consent?<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.washingtonpost.com\/video\/national\/college-students-define-sexual-consent\/2015\/06\/12\/2c06cd5e-114a-11e5-a0fe-dccfea4653ee_video.html\">College Kids Define Consent<\/a><\/p>\n<p><strong>What consent looks like:<\/strong><\/p>\n<p>The following Laci Green video talks about how you can be sure you have affirmative consent.<\/p>\n<p><iframe loading=\"lazy\" title=\"WANNA HAVE SEX? Force includes threats, that overcomes resistance or produces reluctant compliance or acquiescence.<\/li>\n<\/ul>\n<h2>Coercion<\/h2>\n<ul>\n<li>Coercion is an unreasonable pressure to engage in sexual activity. Coercion is distinguishable from seduction, where sexual advances are welcome and persuasion is reasonable. When an individual verbally and\/or physically expresses that they do not want to engage in or continue in a sexual act, continued pressure beyond that point can be coercive. For the purposes of coercion, determining what is unreasonable may be a function of duration, frequency, isolation, and intensity.<\/li>\n<\/ul>\n<h2>Incapacitation<\/h2>\n<ul>\n<li>Incapacitation is a state where someone cannot make rational, reasonable decisions because they lack the capacity to give knowing consent (e.g., to understand the \u201cwho, what, when, where, why or how\u201d of their sexual interaction).<\/li>\n<li>Incapacitation can occur mentally or physically, from developmental disability, by alcohol or other drug use, or blackout. Incapacity may also result from mental disability, sleep, unconsciousness, or from the ingestion of rape drugs. Drinking and\/or drug use may render an individual incapable of giving consent for sexual activity. For example, someone who is incapacitated may agree to have sex at the time, but have no memory of the consent. This person may have been functioning in a \u201cblackout\u201d and could not give effective consent.<\/li>\n<li>If unsure of the state of a person, avoid sexual activity.<\/li>\n<\/ul>\n<h2>Stalking<\/h2>\n<ul>\n<li>Two or more acts, including, but not limited to, acts which directly, indirectly, or through third parties, by any action, method, device, or means, follows, monitors, observes, surveils, threatens, or communicates to or about a person, or interferes with a person&#8217;s property shall constitute stalking.<\/li>\n<\/ul>\n<h3>Prohibited conduct includes, but is not limited to<\/h3>\n<ul>\n<li>purposefully following\/appearing within the sight of that individual<\/li>\n<li>approaching\/confronting that individual<\/li>\n<li>threatening or making obscene gestures<\/li>\n<li>unwanted repeated communication or contact<\/li>\n<li>engaging in surveillance or any other types of unwanted observation<\/li>\n<\/ul>\n<h3>Helpful Tips!<\/h3>\n<ul>\n<li>Trust your instincts! DO NOT downplay the danger<\/li>\n<li>Call 911 if in immediate danger<\/li>\n<li>Do not communicate with the stalker\/respond to their attempts to contact you. This encourages them.<\/li>\n<li>Seek support from friends and family. You don&#8217;t have to go through this alone.<\/li>\n<li>Change email, screen names and phone numbers and be selective about who you give your new ones out to.<\/li>\n<li>Document\/save\/preserve any evidence of harassment<\/li>\n<\/ul>\n<h3>Resources<\/h3>\n<ul>\n<li>Walk with friends or contact MUPD for escorts.<\/li>\n<li>Contact MUPD\/law enforcement for assistance.<\/li>\n<\/ul>\n<h2>Sexual Harassment<\/h2>\n<ul>\n<li>Sexual harassment shall be defined as unwelcome sexual advances, requests for sexual favors, and other verbal, written, online, or physical conduct of a sexual nature in the following context:<\/li>\n<li>Submission to or rejection of such conduct is made, either explicitly or implicitly, a term or condition of a person\u2019s employment, academic standing, or participation in any University programs and\/or activities or is used as the basis for University decisions affecting the individual (often referred to as \u201cquid pro quo\u201d harassment)<\/li>\n<li>Such conduct creates a hostile environment. A \u201chostile environment\u201d exists when such conduct is sufficiently severe, persistent, or pervasive that it unreasonably interferes with, limits, or deprives an individual from participating in or benefiting from the University\u2019s education or employment programs or activities.<\/li>\n<li>Conduct must be deemed severe, persistent, or pervasive from both a subjective and an objective perspective. A hostile environment can be created by persistent or pervasive conduct or by a single or isolated incident, if sufficiently severe. The more severe the conduct, the less need to show a repetitive series of incidents to prove a hostile environment, particularly if the conduct is physical. In contrast, the perceived offensiveness of a single verbal or written expression, standing alone, is typically not sufficient to constitute a hostile environment.<\/li>\n<\/ul>\n<h3>Prohibited Conduct<\/h3>\n<h4>CONDUCT, WHETHER IN PERSON, IN WRITING, BY TELEPHONE, THROUGH SOCIAL MEDIA, BY ELECTRONIC MEANS, OR OTHERWISE, WHICH IS PROHIBITED BY THIS POLICY INCLUDES, BUT IS NOT LIMITED TO:<\/h4>\n<ul>\n<li>Unwelcome sexual flirtation, advances, or propositions for sexual activity.<\/li>\n<li>Continued or repeated verbal abuse of a sexual nature, such as suggestive comments and sexually explicit jokes.<\/li>\n<li>Sexually degrading language used to describe an individual.<\/li>\n<li>Remarks of a sexual nature used to describe a person\u2019s body or clothing.<\/li>\n<li>Display of sexually demeaning objects and pictures.<\/li>\n<li>Offensive physical contact, such as unwelcome touching, pinching, or brushing the body.<\/li>\n<\/ul>\n<h2>Sexual Exploitation<\/h2>\n<ul>\n<li>Sexual exploitation is taking non-consensual or abusive sexual advantage of another for one\u2019s own advantage or benefit, or to benefit a person other than the one being exploited.<br \/>\nProhibited conduct includes, but not limited to:<\/li>\n<li>Sexual voyeurism (such as watching another person undress, use the bathroom or engage in sexual acts without the consent of the person observed)<\/li>\n<li>Taking pictures or video or audio recording, or providing for the observation by a third-party of another in a sexual act, or in any other personal\/private activity without the consent of all involved in the activity<\/li>\n<li>Disseminating sexual pictures, audio, video, or other media without the depicted person\u2019s consent<\/li>\n<li>Communications that are obscene, lewd, or indecent.<\/li>\n<li>Intentionally or recklessly exposing one\u2019s genitals in non-consensual circumstances.<\/li>\n<li>Engaging in prostitution or prostituting another student<\/li>\n<li>Engaging in sexual activity with another person while knowingly infected with human immunodeficiency virus (HIV) or other sexually transmitted disease (STD) and without informing the other person of the infection<\/li>\n<li>Administering alcohol or other drugs (such as \u201cdate rape\u201d drugs) to another person without his or her knowledge or consent.<\/li>\n<\/ul>\n<h2>Domestic and Dating Violence<\/h2>\n<ul>\n<li>Domestic violence is violence or abuse (verbal, physical, and\/or psychological) committed by a current or former spouse of an individual, person with whom an individual shares a child in common, person who is cohabitating with an individual or has cohabitated with as a spouse, or person similarly situated to a spouse of the individual under domestic or family violence laws of the jurisdiction in which the crime of violence occurred.<\/li>\n<li>Dating violence or abuse (verbal, physical, and\/or psychological) committed by a person who is or has been in a social relationship of a romantic or intimate nature with an individual. The existence of such relationship shall be determined based on consideration of the following factors: length of relationship, type of relationship and, frequency of interaction between the persons involved in the relationship. Dating partners can be dating each other exclusively or dating other people concurrently. Dating relationships may have a sexual component, but do not have to. Dating violence does not include acts by a person who meets the definition of domestic violence.<\/li>\n<\/ul>\n<h3>Acts generally fall into one or more of the following categories<\/h3>\n<ul>\n<li>Physical battering &#8211; physical attacks or aggressive behavior<\/li>\n<li>Sexual abuse &#8211; forced sexual intercourse, unwanted sexual activity<\/li>\n<li>Psychological battering &#8211; constant verbal abuse, isolating victims, deprivation of resources<\/li>\n<\/ul>\n<h2>Important Definitions<\/h2>\n<p>A full list of definitions can be found in the Title IX Procedures. Unless otherwise indicated by the Complainant or Respondent in writing, the Advisor shall be provided a copy of all materials provided to the Complainant or Respondent. An Advisor may be called as a witness to provide testimony, but if the Advisor is an attorney, such an Advisor may invoke the attorney-client privilege. The advisor may assist the party by helping to prepare materials, draft questions, and confer with the party during meetings and hearings, as long as this does not unreasonably disrupt or delay the process. For example, a dean of students who oversees student housing, a student center, or student extra-curricular activities has significant responsibility for student and campus activities. Similarly, a director of athletics, team coach, and faculty advisor to a student group also have significant responsibility for student and campus activities. A single teaching faculty member is unlikely to have significant responsibility for student and campus activities except when serving as an advisor to a student group. A physician in a campus health center or a counselor in a counseling center whose only responsibility is to provide care to students are unlikely to have significant responsibility for student and campus activities. Individuals may perceive and experience the same interaction in different ways. Therefore, it is the responsibility of each party to determine that the other has consented before engaging in the activity.<\/p>\n<p>If consent is not clearly provided prior to engaging in the activity, consent may be confirmed by word or action at some point during the interaction or thereafter, but clear communication from the outset is strongly encouraged.<\/p>\n<p>For consent to be valid, there must be a clear expression in words or actions that the other individual consented to that specific sexual conduct. Consent is evaluated from the perspective of what a reasonable person would conclude are mutually understandable words or actions. Reasonable reciprocation can establish consent. For example, if someone kisses you, you can kiss them back (if you want to) without the need to explicitly obtain their consent to be kissed back.<\/p>\n<p>Consent can also be withdrawn once given, as long as the withdrawal is reasonably and clearly communicated. If consent is withdrawn, sexual activity should cease within a reasonably immediate time.<\/p>\n<p>Silence or the absence of resistance alone should not be interpreted as consent. Consent is not demonstrated by the absence of resistance. While resistance is not required or necessary, it is a clear demonstration of non-consent.<\/p>\n<p>Consent to some sexual contact (such as kissing or fondling) cannot be assumed to be consent for other sexual activity (such as intercourse). A current or previous intimate relationship is not sufficient to constitute consent. If an individual expresses conditions on their willingness<br \/>\nto consent (e.g., use of a condom) or limitations on the scope of their consent, those conditions and limitations must be respected. If a sexual partner shares the clear expectation for the use of a condom and that expectation is not honored, the failure to use a condom or removing a<br \/>\ncondom can be considered an act of sexual assault.<\/p>\n<p>Proof of consent or non-consent is not a burden placed on either party involved in a Complaint. Instead, the burden remains on Furman to determine whether its Policy has been violated. The existence of consent is based on the totality of the circumstances evaluated from the perspective of a reasonable person in the same or similar circumstances, including the context in which the alleged misconduct occurred and any similar and previous patterns that may be evidenced.<\/p>\n<p>Going beyond the boundaries of consent is prohibited. Thus, unless a sexual partner has consented to slapping, hitting, hair pulling, strangulation, or other physical roughness during otherwise consensual sex, those acts may constitute dating violence or sexual assault. Consent may never be given by minors, even if the other participant did not know the minor\u2019s age; mentally disabled persons, if their disability was reasonably knowable to a sexual partner who is not mentally disabled; or persons who are Incapacitated.
