Marshall University Sanctioning Procedures for Violating COVID-19 Policies and Guidelines

Marshall University has instituted a policy that requires all faculty, students, and staff to wear masks when indoors. Individuals need to wear masks when on school property and must wear a mask to enter a building as well as social distance for 6 feet.

Faculty in the classroom shall ask student(s) who are not wearing a mask to put one on or to go and get one and come back to class. If they refuse then they are to be asked to leave the classroom and the professor after class fill out the Advocate Incident Report. Which is automatically sent to the Office of Student Conduct. If the student fails to leave the room the professor can dismiss the whole class or contact MUPD.

If someone is violating University, State or local guidelines outside the classroom or residing in off campus housing the student can be referred to the Office of Student Conduct by other students, faculty, staff, neighbors, landlords, HPD, or any member of the Huntington Community by filling out the Advocate Incident Report. Which is automatically sent to the Office of Student Conduct.

Consequences for Non Compliance are as follows

  1. First referral for non-compliance: Students will receive a Formal Warning and have to meet with the Office of Student Conduct before they can return to the classroom if they are non-compliant outside the classroom they shall also be given a Formal Warning and meet with the Office of Student Conduct for a conversation with the Office of Student Conduct. In both incidents student will sign the Keep Marshall Safe Pledge Again.
  2. Second Referral for non-compliance: Student will be placed on Conduct Probation until the end of the semester and a hold will be placed on the students account and won’t be removed until the end of the semester. The student will also have to complete a training program on Health, Wellness and Safety on Blackboard and score 85 % or higher. The student will have five days to complete the training once being given notice of non-compliance. They will also get a call/email from MU Wellness to remind them they must complete the class and they will discuss the Marshall protocols as well as state and local guidelines. If the student fails to complete the training Student Wellness will refer them back to conduct. The student could be subjected to other disciplinary sanctions or suspension.
  3. Third Referral for non-compliance: Student will be suspended from the institution for the remainder of the semester or if classes can be online learning they must take them from home if living in the residence hall if commuting and living off campus they will have to do online learning from their living dwelling until the end of the semester. In either instance students will not be allowed on Marshall’s campus without the authorization of the Office of Student Conduct or MUPD. If the student is found to me on Marshall’s campus then they will be charged with trespassing and will be subject to greater disciplinary actions.

If the student wishes to return to Marshall after their Suspension Period they must meet with the Office of Student Conduct and show a readiness to return to the institution before being allowed to return.

Consequences for Organizations non-compliance on and off campus are as follows

  1. First Referral for non-compliance: The organization will receive a formal warning and the executive committee will have to meet with the Office of Student Conduct. Every member of the organization will have to the Keep Marshall Safe pledge. If the violation happens on campus the student organization will lose their on campus meeting privileges for two weeks.
  2. Second Referral for non-compliance: The organization will be placed on Conduct Probation until the end of the semester. Every member of the organization will have to complete the Health, Wellness and Safety training in blackboard with every member scoring 85% or higher. The training must be completed by all members within 5 days of getting notice of non-compliance. The President/Vice-President and Advisor will get a call/email from Wellness to remind them of the training for all members. They will also discuss with them the Marshall Protocol as well as state and local guidelines. If any member fails to complete their test they will be referred back to the Conduct Office removed from the organization and or suspended.
  3. Third referral for non-compliance: The organization will be suspended from the University for a semester and they will lose recognition as a recognized University organization. If the organization is suspended and they hold meetings they could be subject to greater disciplinary actions.

If the organization wishes to return to Marshall after their Suspension Period they must meet with the Office of Student Conduct and the Office of Student Involvement and Leadership they must show a readiness to return to the institution before being allowed to return.
