Enforcement of the OPT and Employer Information Requirement

On January 4, 2021, US Immigration and Customs Enforcement (ICE) and the Student and Exchange Visitor Program (SEVP) notified SEVP-certified schools about a recent enforcement operation and to remind DSOs of the obligations to properly update the OPT and employer information requirement in SEVIS.

All nonimmigrant students who are engaging in OPT are required to report employment to a DSO at their school and to the SEVP Student Portal within 10 days of any employment changes. Failure to do so could result in students exceeding their allotted days of unemployment, which could result in termination of the SEVIS record and becoming subject to removal proceedings.

As a reminder, students participating in post-completion OPT are allotted 90 days of unemployment, or 150 days in the aggregate if engaged in the STEM OPT extension.

Please be sure that your OPT employment information is up to date in your SEVP Student Portal, and if it is not, please contact our office immediately so that we can help you update your employment information.
